These Terms of Use (hereinafter the "Terms") govern your access to and use of the Korysnyk mobile application, the korysnyk.care website and the dashboard.korysnyk.care web account (together, the "Service"), which are owned and operated by Korysnyk LTD
By downloading, installing, registering or otherwise using the Service, you confirm that you have read these Terms, understood them and agree to abide by them. If you do not agree with any provision of the Terms, do not use the Service
In these Terms, "we", "us", "our" mean Korysnyk LTD. "You" and "your" mean the natural person who uses the Service

The information provided by the Service, including the results of Lumi, Swapr and the responses of the AI assistants (in particular the Medic assistant), is of an exclusively informational and educational nature. It is not medical advice or a diagnosis, prescription, recommendation or change of treatment, a substitute for professional consultation with a doctor, pharmacist, dietitian or other qualified medical specialist
Always consult a doctor on health matters, especially in the case of pregnancy, breastfeeding, the presence of chronic diseases, the taking of medications or when an allergic reaction is suspected. Do not make or change decisions about your health solely on the basis of information from the Service. In the case of an acute medical situation, contact emergency services
To use the main functionality of the Service, it is necessary to create an account using an email address and a password. You may use the Service only if you are 16 years of age

We use JWT authentication with access and refresh tokens, proactive token refresh and restriction of actions (rate-limit) for security. You accept that these measures may lead to a forced logout from the account in the event that suspicious activity is detected
You may voluntarily provide information about allergies, food intolerances, chronic diseases, dietary restrictions, skin type and other parameters for the personalization of analysis

Your access plan defines the daily and weekly limits on actions in the Service (scanning, creating chats, sending messages, submitting products for moderation). The Basic plan is free and has basic limits. Premium plans multiply the basic limits by the coefficient of the corresponding tier (×2, ×5, ×10)
The current values of the limits are indicated on the pricing page of the korysnyk.care site. We reserve the right to change the limits with notice of at least 30 days before the changes take effect, except in cases of combating abuse, when the limits may be changed immediately
Attempts to circumvent the limits through the creation of multiple accounts, automated requests or other means constitute a violation of these Terms
At the time of the beta version, paid subscriptions may be unavailable or have limited availability. If you take out a paid subscription, the following rules apply
Payments are processed through the Apple App Store or Google Play Store in accordance with their terms and refund rules. We do not have direct access to your payment data, card or account
Subscriptions are taken out with automatic renewal until you cancel them through the settings of your account in the App Store or Google Play. Cancellation takes effect at the end of the current paid period
Refund requests are processed in accordance with the rules of the Apple App Store or Google Play through which the payment was made. Korysnyk LTD cannot make direct refunds of funds paid through these platforms
If you are a consumer in the European Union, you have the right to withdraw from a paid subscription within 14 days of ordering without stating a reason in accordance with Directive 2011/83/EU. The exercise of this right is carried out through the relevant app store. Please note that this right does not apply after you have begun active use of the premium functionality and confirmed the waiver of the 14-day period
We may change subscription prices with notice of at least 30 days. New prices apply only to the next renewal period. You may cancel the subscription if you do not agree with the new price
User content means any materials that you submit or publish through the Service, in particular photos of product packaging for moderation, comments on products, messages in AI chats, likes, dislikes, bookmarks

By submitting content through the Service, you grant Korysnyk LTD a free, worldwide, non-exclusive license with the right to transfer to processors, perpetual (for content accepted into the product database) or limited to the lifetime of the account (for the remaining content), to
This license terminates in respect of content that you delete, except in cases where the content has already been integrated into the public product database (packaging photos) — in such a case the content remains in the database without a link to your account
We may review, edit or delete user content at our own discretion, in particular in the case of a violation of these Terms, complaints of third parties or legal requirements. We are not obliged to pre-moderate all content and are not responsible for user content that has not undergone moderation

All intellectual property rights in the Service, in particular the software code, interface design, trademarks, logos, the product database, the ingredient database, analysis texts, the system prompts of the AI assistants and the documentation, belong to Korysnyk LTD or the relevant rights holders
Subject to compliance with the Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal non-commercial purposes
The Service contains open-source components and other third-party components that are licensed under their own terms. A list of such components is available upon request at admin@korysnyk.care. Third-party licenses take precedence over these Terms in matters of their respective components
If you believe that the Service contains content that infringes your intellectual property rights, send a notice to admin@korysnyk.care stating

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all express and implied warranties, in particular warranties of fitness for a particular purpose, accuracy, uninterrupted operation, absence of errors and freedom from failures

Consumers in the United Kingdom are protected by the Consumer Rights Act 2015. You may terminate use of the Service at any time by deleting the application and your account through the settings or the korysnyk.care/delete-account page
We may suspend or terminate your access to the Service with notice or without it in the case of

We are not liable for the non-performance or delay in the performance of obligations under these Terms caused by circumstances beyond our reasonable control, in particular natural disaster, war, armed conflict, acts of the authorities, power outages, cyberattacks, the failure of infrastructure or internet-service providers
We may change these Terms from time to time. We will notify of material changes through the application or by email at least 30 days before the changes take effect. Immaterial changes (correction of errors, clarification of wording, updating of contacts) may take effect from the moment of publication
Continued use of the Service after the changes take effect means your acceptance of the updated Terms. If you do not agree with the changes, you must terminate use of the Service
The date of the last update is indicated at the beginning of the document
These Terms are governed by and interpreted in accordance with the law of England and Wales, without regard to its conflict-of-law rules
Any disputes arising out of or in connection with these Terms are subject to the exclusive jurisdiction of the courts of England and Wales. This provision does not deprive consumers of the right to apply to a court at their place of permanent residence under the mandatory rules of consumer legislation
The parties will make reasonable efforts to reach an amicable settlement through negotiations before applying to a court. A claim is submitted to admin@korysnyk.care
If any provision of these Terms is found to be invalid, unlawful or unenforceable, this does not affect the validity of the remaining provisions, which remain in full force
Our failure to take action regarding a violation of these Terms does not mean a waiver of the right to take such action in the future regarding the same or a different violation
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Korysnyk LTD regarding the Service and supersede all prior oral or written arrangements
You do not have the right to transfer your rights or obligations under these Terms to third parties without our written consent. We may transfer our rights and obligations within the framework of a corporate reorganization or a sale of the business with notice
